Notice of Assessment

The 2019 maintenance fee, which is collected in arrears, has been set at $192.00 per lot, representing a 0% increase over the amount of the assessment levied for the previous year.  This amount is due on January 1, 2020, and it will become delinquent if not paid by February 1, 2020.  If your fees become delinquent, a late fee of 6% APR will be assessed on any unpaid balance.

The Kenswick HOA also passes through an Electricity Service Fee in the amount of $42.71.  This fee was the expense per resident of providing streetlight and Common Area electricity service in 2019.

Installment Payments

You may pay your assessment over time; however your payment plan must be approved in writing on the Association’s payment plan form.  Forms are available for download online at www.kenswickhoa.com.  If you enter into a payment plan, payments must be made at least monthly, and interest will continue to accrue on the unpaid balance.  Payment Plan requests must be accompanied by a $25.00 application fee.  Partial payments made without a written Payment Plan will not suspend the Association’s collection measures.  All partial payments will be charged a $5.00 per payment administrative processing charge.

Notice of Collection Policies

For balances that remain outstanding on or after March 1, a collection demand letter will be sent by certified and regular mail with an additional $35.00 collection charge added to your account balance.

Account holders who have received a collection letter and who remain delinquent on or after May 1 may be assigned to the association’s attorney for collection.  Once this assignment takes place, all contact regarding your account will be through the attorney.  The attorney’s fees (which will be substantial) will be collected as part of your account balance.  The attorney will send foreclosure demand letters and appropriate notification to your mortgage company, if any.  Failing these collection attempts, the attorney will seek to foreclose the Association’s lien through foreclosure lawsuit.

Other Administrative Policies

NSF checks will incur a $25.00 NSF check charge.

Statements are rendered by the Association as a courtesy and will not include all legal fee charges if the account has been assigned to the Association’s attorney.

Statements are mailed to property owners only.  Duplicate copies for mortgage, tax, and title companies are available upon request to https://www.homewisedocs.com.

Important:  Address changes will be recognized only if requested on the Association’s official change of address form or by advice from a title company pursuant to a real estate closing.

Notice of Regular Board Meeting

The Board of Directors of the Kenswick Homeowners’ Association, Inc. will hold a regular meeting on October 24, 2019, at the CAM Office, 9802 FM 1960 Bypas Suite 210, Humble, TX 77338.  Open Session is scheduled to begin at 7:00 p.m., and visitors are welcome.

The subject of the meeting is general business of the Association, including monthly reports. If you wish to be scheduled to speak at this meeting, please contact the Association’s office at (281) 852-1155 not later than three days prior to the scheduled meeting.

An Executive Session is scheduled.  Items that may be discussed in this closed session include: actions involving personnel, pending or threatened litigation, contract negotiations, enforcement actions, confidential communications with the Association attorney, matters involving invasion of privacy of owners, and other matters that are confidential by request of an affected party and agreement of the Board.

Garage Sale Signs

While reserving the right to do so, the Board of Directors of the Kenswick Homeowners' Association does not seek to regulate garage sales in the Kenswick community.  The Board has, however, issued this request:

The CenterPoint Easement behind Swan Meadow

For Owners on Swan Meadow Lane

If you have electric lines behind your house . . .

 

In conjunction with CenterPoint Energy, your homeowners association arranged to have the utility easement behind your residence cleared in late 2014.  They sent a letter to you at the time advising you that you own the property under the electric utilities, and that you are required to keep that area clear and free of trash.  This includes mowing behind your house.

 

 

If you choose to do so, you may install a gate in your existing rear fence to access the area.  If you don’t already have a fence in the easement area, you may build one; however, if you choose to build a fence on your side property line in this easement, you must allow gate access for passage of CenterPoint equipment.

 

 

The Board of Directors of Kenswick Homeowners’ Association will require you and your neighbors to continue to maintain the area behind your residence for the health, safety, and aesthetic appeal of the entire Kenswick community.  Your abandonment or abuse of this area will not be tolerated.  This shall serve as notice that any such abandonment, dumping, or abuse will be pursued by deed restriction enforcement and by all legal means available to the Association.

Trimming Trees

School buses, fire trucks, trash haulers -- all such necessary municipal vehicles are having a hard time driving down some of the streets in the Kenswick community.  Since Kenswick is a mature community, many of its beautiful trees have matured as well.  Of course the trees native to this area grow laterally as much as they do in height.  The result is a beautiful canopy, but it is also in impediment to larger vehicle traffic when it spreads over the street.

To address this situation, the Board of Directors of Kenswick H.O.A. has stipulated that such interference into the roadway area constitutes a nuisance to the community, and that it will be pursued as a violation of the deed restrictions.

Many of our neighbors have already received a notification stating:

Trimming of tree overhanging street is required. The Board of Directors has ruled that trees overhanging the street have an adverse effect on school buses and fire trucks moving through the community.

The Board urges you to respect this requirement in the event you receive such a notification.

The Board has also been advised that the Harris County Community Assistance department (http://www.hcp4.net/cad/index.htm) may offer trimming over the street on an individual basis.  However, each individual owner must request the service for his/her own property in order for the Community Assistance Department to respond.
